No that this point was not raised by Obama's lawyers. Hm, I wonder why?
Well, Obama's lawyers thought that Scalia would be on their side if they quoted his own opinions in their argument.
This is an indication that these people are seriously delusional and incompetent, but think that they are geniuses.
A less oprimistic view would be that they did not use that argument because Obama wants to privatize Social Security.
